The United States intends to revise toy safety standards and add requirements for toys containing button batteries
On July 10, 2024, the U.S. Consumer Product Safety Commission (CPSC) issued a proposal on "Requirements for toys containing button/coin batteries". CPSC staff recommended that the Commission issue a draft notice of proposed regulations (NPR) to establish new mandatory standards for "toys containing button/coin batteries" to ensure that these toys achieve the highest feasible safety requirements.
The Commission voted unanimously to approve the publication of the "Requirements for Toys Containing Button/Coin Batteries" notice in the Federal Register, which will add the following test requirements:
Anti-loosening design of screws on battery covers;
Basic requirements for threaded fasteners;
Continuous use;
Abuse testing (stress relief, battery replacement, impact, extrusion, torsion, tension, pressure and compliance verification testing);
Update identification and labeling requirements.
It is worth noting that the additional content of the NPR is stricter than the requirements of the ASTM F963-23 standard. This can be seen as an extension of the Reese Act and UL 4200A-23 standard requirements for toys to further reduce the risk of injury caused by these batteries and represent the highest level of safety to address the problem of children ingesting button/coin batteries from toys.
The Notice of Proposed Regulation (NPR) was officially published in the Federal Register on August 13, 2024. The public can provide feedback and comments within 60 days of the date of publication (i.e. before October 15, 2024).
Expected effective date: 180 days after the final rule is published and approved.
